Penalties for Cannabis Possession in Toronto Old City Hall punishes potheads with community service by Mark Stupak, Toronto420.com
Source: Fellow pothead charged with possession of 28.3 grams of Cannabis from a raid on his house. Lets call him John Doe.
The bust on John Doe's property happened approximately 2 months ago. The raid occurred because of an unrelated problem with a pot activist who happens to share the same house as John Doe. The raid was directed towards a marihuana activist but luckily he was not in the house at the time of the raid. The cops from the 51ths Division in Toronto Downtown found No Guns, Pounds of pot nor a woman being held with a gun as they were expecting from an apparent 911 call to emergency services (or so they claim). The court files in relation to WHO CALLED IN THE POLICE were blacked-out by the police so we do not know if the reason for the bust was real or the cops just made up the story (I know this was not a 911 call that precipitated the bust, but the cops do not want to acknowledge this....). John Doe was found in possession of an ounce of cannabis.
He went to the Old City Hall in Downtown Toronto and was re-directed to the Drug Court which pulled him aside and offered him 25 hours of community service for possession of 25 grams of pot (he had 28.3 so we learned they will make a deal if its within their interest). They also explained that if he was smoking a joint in his car his penalty would have been 25 + 10 hours of community service and if he was smoking a joint in the park add another 10 hours as this is a public space. This works (apparently) only for the first time offenders. After the deal you pay $70 (processing fee or as I call it hidden taxes) and have no criminal record. John Doe took the deal because he is not an activist but a regular Joe who needs to travel to the States.
So to summarize. If you get caught by Toronto (Cannabis) Police with 25 grams of pot you will receive 25 hours of community service and no record. If you possess 25 grams and were smoking a joint in your car you get 35 hours community service and if you are possessing and smoking in the park you'll get 45 hours of community service.
So here you are warned about possession in Toronto.
